Please take a few moments to read through this Privacy Policy {“Policy”) and review our Terms and Conditions of Use (“Terms”) carefully. The Terms and Policy govern your access to, and use of, MouthMedia™ Network, websites, APIs, apps, software, content, and other services (“Services”). The Policy explains how we collect, use, share, and disclose information that you provide to us and your rights. Your access and use of our Service is express consent to Company’s collection, storage, transmission, use, and disclosure of your information as it is described in this Policy. If you do not consent to anything within this Policy, do not use the Service.

1. INFORMATION THAT WE COLLECT.

A. INFORMATION THAT YOU PROVIDE.

As a Listener, Publisher, or Advertiser using our Service or our website, you will be prompted to share information with us from time to time. Logging in to the Service via LinkedIn or Facebook accounts provides us information about those accounts. We collect username and email if you choose to use that method to sign up for an account. We also collect additional profile information, if you choose to fill out a profile, and information on friends and connections if you choose to use the social aspects of the Service. You do have the ability to use a limited form of this Service anonymously.

B. INFORMATION THAT WE COLLECT.

This Service automatically collects and logs information about usage of the Service. We collect information about listening preferences to help provide you with accurate recommendations. We also track interaction behavior within the Service in an anonymized manner to help Publishers improve their offerings. As part of this logging, we use information about your system and geographic information.

As an Anonymous Listener, we capture session information. If you choose to set up an account while within an Anonymous mode, information from the active session will be transferred to your new account. Information from previous Anonymous sessions may be lost.

C. INFORMATION THAT WE PROCESS.

We work with third party services to help us understand the users of our Service. We provide our data partners with data sufficient to build usage and demographic profiles. Doing so helps Publishers improve their content and monetize their podcasts and helps Advertisers provide information about products that are relevant to Listeners of a specific podcast. We also use this information to generate more accurate search results and recommendations.

We generate reports on Listener audiences from the anonymized interaction data. These reports rely on third party services to process the information flow, so we send data to our third party service providers. We never sell your data.

D. ADDITIONAL INFORMATION YOU SHARE.

When you share links on social media or post information to third party websites, we capture information about such uses. Please be sure that you understand the terms and conditions of such third party providers. When you provide your contact information to a Publisher, you are giving them permission to contact you. When you make a purchase, you are providing billing information and are authorizing a transaction.

2. USAGE OF INFORMATION.

Our goal is to provide you with the best Service and to constantly improve our services, websites, and products. We are capturing information to provide better recommendations, develop our user interfaces, and provide more relevant podcasts, ads, and products to you. We also use information that is gathered for our marketing materials and we use some information for commercial purposes.

3. SHARING OF INFORMATION.

A. TO THOSE MAINTAINING THE SERVICE.

Our employees, affiliates, consultants, contractors, distributors, publishers, suppliers, and vendors receive access to a portion or all of the information gathered, depending on their roles. These include maintaining and improving the Service, processing data, marketing the Service or individual podcasts, and teaching others how to use the system. We only provide access to information as necessary to perform the respective roles.

B. TO GOVERNMENT AUTHORITIES.

We will disclose your information to government authorities if required to do so by law or in response to a subpoena, court order, or similar request. We may also disclose your information to government authorities if we believe, at our sole discretion, that doing so is necessary to protect the rights of other users, protect against fraud, or that you have abused the Site or Service in a way that violates applicable laws.

Once information is submitted in such a way, it may be viewable by a third party or accessible to others beyond the ways anticipated within this policy.

C. TO OUR AFFILIATES.

Some or all of your information is shared with our parent company, Open Source Business Inc., and may be available to other companies under common control.

D. TO THIRD PARTY MARKETING PARTNERS.

We may engage with third party marketing agencies and service providers from time to time. We may disclose information to them to help them provide their services in an efficient and effective manner.

E. IN THE EVENT OF BANKRUPTCY OR SALE OF COMPANY.

If there is a merger, acquisition, bankruptcy, or other sale of the company or our assets, accumulated user information shall be considered an asset and may be one of the transferred assets. We may transfer your information and information from third party providers to the acquiring company, subject to this Policy, however, the acquiring company may change this Policy thereafter.

F. ANONYMIZED DATA.

We anonymize and aggregate all interaction data that we provide to Publishers and Advertisers. It may be possible for this anonymized data to be processed in such a way so as to identify you individually.

G. SPECIAL ACCOUNTS.

Accounts set up for Companies, Academic Institutions, and Parents may have different Privacy Policies than this Policy. Please review such policies when signing up for these ancillary services.

4. SECURITY.

We use industry standard security measures to protect your information. We cannot guarantee or warrant the security of the information that you provide us. We will take all reasonable precautions, but use of the Service is at your own risk.

5. CHILDREN’S ONLINE PRIVACY PROTECTION RULE COMPLIANCE.

This Service is not available to children under the age of 18. Parents or guardians may set up an account for a child between the ages of 14 and 18. We do not collect information about or from children under the age of 13 and usage of this Service by a child under the age of 13, other than through a Parent account, is a violation of our Terms of Service.

6. AMENDMENTS.

Any changes or amendments to this Policy shall be posted within the App or on our site prior to such changes or amendments taking effect. You must discontinue use of the Service if you do not accept such modifications. Otherwise, continued use of the Service constitutes express consent to the new Policy.

7. INTERSTATE AND INTERNATIONAL USAGE.

This Service is only available within the United States. Usage outside of the United States is a violation of the Terms and Policy. California residents may request and receive, once per year, a notice describing the personal information we may have shared with third parties for direct marketing purposes during the preceding calendar year. California residents should email us at california@mouthmedianetwork.com to make such a request. Underage California residents may also request for information to be removed from the site, however, we are not required to remove such content if state or federal laws require the maintenance of such information; another user posted, stored, or republished the information; the minor cannot be identified because the information is anonymized; compensation or consideration was received for the information; the instructions in this Policy were not followed or the request is not clear.
